• A family who lost their father when a tire malfunctioned causing the vehicle to overturn. This case was particularly complicated because although the victim was a New York resident, the accident happened while he was on vacation in Montreal. Our attorneys flew to Montreal to examine the accident scene, interview the Canadian police, and take accident photos, thus discovering that the real cause was a defective tire blowout and that the suit should be against the manufacturer of the tire, not the vehicle. Against the wishes of the defendant, we were also successful in defeating the attempt to move the litigation to Canada, which does not permit these kinds of claims.
• We were able to achieve a seven-figure settlement for a worker who lost a hand while standing next to a large industrial press. Someone on the other side of the machine turned it on, and the rollers pulled our client’s hand and arm into the machine. The complexities in this case had to do with the various components of the equipment being made by several different manufacturers, with issues of equipment service and maintenance, and many complexities at the corporate level.
• Another products liability client was the owner of an Italian grocery that made fresh pasta. The pasta-making machine was designed to automatically shut off when the lid was opened. However, when the grocery owner opened the lid to add ingredients, the machine did not shut off, but instead did such severe damage that he lost the hand. The manufacturer was in Italy with no United States offices or employees. We were again able to achieve a seven-figure settlement for this client by locating the distributor and proving that the machine had malfunctioned.
