Class action lawsuits are appropriate when a large number of people have been harmed by the action or conduct of an individual or a company and the injuries suffered by the victims are too small to justify individual claims against the defendant. In addition to the individual damages being small (sometimes only a few dollars per class member), all members of the class have very similar damages. A class action allows the entire group of victims to sue the wrongdoer for the same type of damages so that all members of the class can receive compensation for their injuries.
As an example, if a large number of consumers have been deceived into purchasing a product that does not perform as advertised, a class action can be formed to sue the manufacturer for damages. In this example, the cost of the product may be too small to justify individual claims against the manufacturer. However, by joining together as a class, each member of the group may be entitled to some compensation.
As a consumer, if a large company sold you a product or a service, but deceived you as to the nature or value of the product or service, or if the product hurts you in some way, you deserve to receive compensation, no matter how small the damages may seem to be.
The consumer class action lawyers at Trief & Olk have pursued class action lawsuits against large companies based on consumer fraud and deception. Some examples of pending class action lawsuits as well as class actions we have recently handled include:
• A class action lawsuit against one of the largest owners of shopping malls in the country. The corporation sold gift cards to consumers without informing them that if the card was not used for seven months after being issued, the corporation would apply a monthly “administrative fee” of $2.50 to the balance of the card until the balance is zero.
• A class action against a large phone card company that deducted minutes from its phone cards at higher rates than what was expressly stated on the cards.
• A class action lawsuit against a vocational school for its failure to provide the educational training promised. The vocational school filed bankruptcy after class certification was obtained.
• A consumer class action lawsuit against a wireless cell phone company related to its refusal to allow cancellation during the billing month after the contract period expired. In this case the damages suffered by each member of the class were typically in the range of $10 - $30. However, because it was a class action, the individual damages did not have to be calculated separately.
If you believe that you were harmed or defrauded when you purchased a consumer product or service and that there may be a large number of other people who have been deceived in the same way, please call or email the consumer class action lawyers at the New York and New Jersey law firm of Trief & Olk. Our experienced attorneys will investigate your claim to determine if it justifies a class action lawsuit.
